Community Association:
Q: A homeowner in our association told the board that they will not pay their maintenance fees until we fix a problem that exists near by their unit. May they do that?
Q: A homeowner with a handicap has requested that the association install a ramp to the entrance of their unit. Must the association do this?
Q: A homeowner who walks with the aid of a cane has requested a designated parking space, even though we do not have assigned parking. Should we provide one?
Q: A homeowner is clearly violating the "no pets" restriction in the governing documents. He is asking for ADR. Must we provide ADR when the violation is obvious and no purpose will be served by any ADR process?
Q: Our documents prohibit the operation of a "business" in a unit. Several of our owners maintain "home offices," where they make and receive telephone calls, send and receive faxes, and telecommute with their central offices. They do not, however, see clients or customers at their units, nor do they receive regular deliveries of packages. Must we enforce the no-business rule against them?
Q: A homeowner in our condominium association has requested permission to install a satellite dish. Must we permit this?

 

Residential Real Estate:
Q: The other party to my closing just called and told me that he can't close on the contract closing date. Is he in default?
Q: I have to know whether I have a firm deal and am anxious to conclude the attorney review period. Can't we just send  a letter to the other attorney stating our position and indicating that if he doesn't respond in two business days he will be deemed to have accepted the position set forth in our letter?
Q: Will the deposit be given to me if my buyer breaches the contract?
Q: I am selling my home and I have an underground storage tank that I have not used for years, since the house is now heated by gas. Do I need to do anything with the underground storage tank?
Q: My broker has asked me to fill out a disclosure statement that asks many questions. Since the buyer will be having inspections anyway, and should be undertaking his own inquiries concerning the property, do I have to answer these questions?
Q: I am moving to New Jersey from out of state, and am contemplating the purchase of a newly constructed home. I must close by the end of August so that my children can start school on time. Will my builder have the home ready on time? And what can I do to insure that?
Q: There are so many people involved in my real estate transaction, the sales agent, attorney, home inspector, mortgage lender, etc. I do not know who to go to with my problem. What do you suggest?
